These Terms of Use govern your use of Lumina 3D and related services.
1) Provider / Contact
This app (“Lumina 3D”) is provided by:

2) Scope
These Terms of Use apply to the use of the Lumina 3D app and its features for capturing, processing, viewing, organizing, and exporting image and scan data, including LiDAR point clouds, camera poses, metadata, and COLMAP-compatible datasets.
By using the app, you agree to these Terms of Use. If you do not agree, you must not use the app.
3) Purpose of the app
Lumina 3D is a professional capture and dataset preparation app for 3D scanning, photogrammetry, Gaussian Splatting, and related reconstruction workflows.
The app is designed to help users capture and prepare datasets for further processing in Lumina 3D or in third-party tools. Lumina 3D is not a guaranteed measurement, inspection, surveying, or certification tool.
4) Accounts, Sign in with Apple, and subscriptions
Some features of the app may require an account created via Sign in with Apple and an active subscription purchased through Apple.
You are responsible for maintaining access to your Apple account and for complying with Apple’s terms for Sign in with Apple, subscriptions, billing, renewals, cancellations, trials, and offer code redemption.
Access to paid features may change if:
- a subscription expires,
- a trial ends,
- a payment fails,
- a subscription is canceled,
- or Apple reports that access is no longer active.
5) System limitations / result quality
The quality of the generated results depends on many factors, including:
- device and sensors (camera/LiDAR, calibration, temperature, CPU/GPU),
- capture conditions (motion, motion blur, exposure, ISO, rolling shutter),
- lighting conditions, reflections, glass, mirrors, screens, and dark scenes,
- scene structure (too little parallax, too little texture, repetitive patterns),
- and subsequent processing in Lumina 3D or third-party software.
There is no guarantee that any scan, export, or reconstruction will be correct, accurate, complete, uninterrupted, or fit for a particular purpose.
6) User responsibility
You are solely responsible for:
- lawful use of the app,
- obtaining all required rights, permissions, and consents,
- compliance with privacy, copyright, property, and other applicable laws,
- secure storage, transmission, and use of your data,
- and verifying whether generated outputs are suitable for your intended workflow.
You must not use the app in a way that infringes third-party rights or violates applicable law.
7) Data processing / privacy (current status)
Lumina 3D primarily processes scan and image data locally on the device.
Account and subscription-related information may be processed as required for Sign in with Apple, entitlement checks, subscription handling, and app access control.
Deluva currently does not use analytics or advertising trackers inside the app.
Note: operating systems and Apple services may process diagnostic, billing, or subscription-related information at the system level. Deluva does not have access to the content of your scans unless a feature explicitly uploads data to a Deluva-controlled service.
8) Third-party software & export compatibility
Lumina 3D can create data in export structures intended for use with third-party workflows and software such as COLMAP, Postshot, RealityScan, or similar tools.
Third-party tools are not part of this app and remain subject to the respective providers’ own licenses, terms, and technical limitations.
Deluva does not guarantee permanent compatibility with any third-party software, workflow, file format, or future software version.
9) Disclaimer of warranty / “As Is”
The app is provided “as is” and “as available”. Use is at your own risk.
Deluva does not guarantee:
- uninterrupted or error-free operation,
- permanent availability of features,
- compatibility with all devices, operating systems, or third-party tools,
- or any specific reconstruction, export, or training result.
10) Limitation of liability
To the extent permitted by law, Deluva is not liable for:
- inaccurate, incorrect, incomplete, or unusable scan/export data,
- reconstruction errors, offsets, double contours, distorted results, or failed trainings,
- data loss, file corruption, interrupted workflows, or export failures,
- outages, performance issues, overheating, battery drain, or device throttling,
- damages resulting from downstream use of generated data,
- indirect damages, consequential damages, or lost profits.
Where liability cannot be excluded, it is limited to the extent permitted by applicable law.
11) No safety-critical use
The app must not be used for safety-critical, health-related, or legally decisive purposes, including for example:
- structural analysis or building acceptance,
- medical diagnosis or therapy decisions,
- safety-relevant navigation or surveying,
- or official/legal evaluation as the sole basis for a decision.
12) Updates / changes
Deluva may update, modify, suspend, or remove app features at any time.
There is no entitlement to specific functions, interfaces, export formats, compatibility, or permanent availability.
13) Support
Support may be offered at Deluva’s discretion and within reasonable effort unless otherwise agreed separately.
14) Termination / restriction of use
You may use the app only while you comply with these Terms of Use and any applicable subscription requirements.
Deluva may restrict or terminate access where legally permitted, for example in cases of misuse, abuse, fraud, technical risk, or violation of these terms.
15) Final provisions
German law applies, to the extent permitted by law. Place of jurisdiction is Berlin, insofar as legally permissible.
If any provision of these Terms of Use is invalid, the remaining provisions remain unaffected.

2) Geltungsbereich
Diese Nutzungsbedingungen gelten für die Nutzung der Lumina 3D App und ihrer Funktionen zur Erfassung, Verarbeitung, Anzeige, Organisation und zum Export von Bild- und Scandaten, einschließlich LiDAR-Punktwolken, Kameraposen, Metadaten und COLMAP-kompatiblen Datensätzen.
Mit der Nutzung der App stimmst du diesen Nutzungsbedingungen zu. Wenn du nicht zustimmst, darfst du die App nicht verwenden.
3) Zweck der App
Lumina 3D ist eine professionelle App zur Erfassung und Vorbereitung von Datensätzen für 3D-Scanning, Photogrammetrie, Gaussian Splatting und verwandte Rekonstruktions-Workflows.
Die App soll Nutzern helfen, Datensätze für die weitere Verarbeitung in Lumina 3D oder in Drittanbieter-Tools zu erfassen und vorzubereiten. Lumina 3D ist kein garantiertes Mess-, Prüf-, Vermessungs- oder Zertifizierungswerkzeug.
4) Accounts, Mit Apple anmelden und Abonnements
Einige Funktionen der App können einen über „Mit Apple anmelden“ erstellten Account sowie ein aktives über Apple abgeschlossenes Abonnement erfordern.
Du bist dafür verantwortlich, den Zugriff auf deinen Apple-Account aufrechtzuerhalten und die Apple-Bedingungen für Sign in with Apple, Abonnements, Abrechnung, Verlängerungen, Kündigungen, Testphasen und Angebotscodes einzuhalten.
Der Zugriff auf kostenpflichtige Funktionen kann sich ändern, wenn:
- ein Abonnement abläuft,
- eine Testphase endet,
- eine Zahlung fehlschlägt,
- ein Abonnement gekündigt wird,
- oder Apple meldet, dass der Zugriff nicht mehr aktiv ist.
5) Systemgrenzen / Ergebnisqualität
Die Qualität der erzeugten Ergebnisse hängt von vielen Faktoren ab, darunter:
- Gerät und Sensoren (Kamera/LiDAR, Kalibrierung, Temperatur, CPU/GPU),
- Aufnahmebedingungen (Bewegung, Bewegungsunschärfe, Belichtung, ISO, Rolling Shutter),
- Lichtverhältnisse, Reflexionen, Glas, Spiegel, Displays und dunkle Szenen,
- Szenenstruktur (zu wenig Parallaxe, zu wenig Textur, wiederholende Muster),
- und nachgelagerte Verarbeitung in Lumina 3D oder Drittanbieter-Software.
Es gibt keine Garantie dafür, dass ein Scan, Export oder eine Rekonstruktion korrekt, exakt, vollständig, unterbrechungsfrei oder für einen bestimmten Zweck geeignet ist.
6) Verantwortung des Nutzers
Du bist allein verantwortlich für:
- die rechtmäßige Nutzung der App,
- das Einholen aller erforderlichen Rechte, Genehmigungen und Einwilligungen,
- die Einhaltung von Datenschutz-, Urheber-, Eigentums- und sonstigen geltenden Gesetzen,
- die sichere Speicherung, Übertragung und Nutzung deiner Daten,
- sowie die Prüfung, ob erzeugte Ausgaben für deinen beabsichtigten Workflow geeignet sind.
Du darfst die App nicht in einer Weise nutzen, die Rechte Dritter verletzt oder gegen geltendes Recht verstößt.
7) Datenverarbeitung / Datenschutz (aktueller Stand)
Lumina 3D verarbeitet Scan- und Bilddaten primär lokal auf dem Gerät.
Account- und abonnementsbezogene Informationen können verarbeitet werden, soweit dies für Sign in with Apple, Entitlement-Prüfungen, Abonnementverwaltung und Zugriffssteuerung der App erforderlich ist.
Deluva verwendet derzeit keine Analytics- oder Werbetracker innerhalb der App.
Hinweis: Betriebssysteme und Apple-Dienste können Diagnose-, Abrechnungs- oder abonnementsbezogene Informationen auf Systemebene verarbeiten. Deluva hat keinen Zugriff auf den Inhalt deiner Scans, es sei denn, eine Funktion lädt Daten ausdrücklich zu einem von Deluva kontrollierten Dienst hoch.
8) Drittsoftware & Export-Kompatibilität
Lumina 3D kann Daten in Exportstrukturen erzeugen, die für Drittanbieter-Workflows und Software wie COLMAP, Postshot, RealityScan oder ähnliche Tools vorgesehen sind.
Drittanbieter-Tools sind nicht Teil dieser App und unterliegen den jeweiligen eigenen Lizenzen, Bedingungen und technischen Einschränkungen.
Deluva übernimmt keine Gewähr für eine dauerhafte Kompatibilität mit Drittanbieter-Software, Workflows, Dateiformaten oder zukünftigen Softwareversionen.
9) Gewährleistungsausschluss / „As Is“
Die App wird „wie besehen“ und „wie verfügbar“ bereitgestellt. Die Nutzung erfolgt auf eigenes Risiko.
Deluva garantiert nicht:
- einen unterbrechungsfreien oder fehlerfreien Betrieb,
- die dauerhafte Verfügbarkeit von Funktionen,
- die Kompatibilität mit allen Geräten, Betriebssystemen oder Drittanbieter-Tools,
- oder ein bestimmtes Rekonstruktions-, Export- oder Trainingsergebnis.
10) Haftungsbeschränkung
Soweit gesetzlich zulässig, haftet Deluva nicht für:
- ungenaue, fehlerhafte, unvollständige oder unbrauchbare Scan-/Exportdaten,
- Rekonstruktionsfehler, Offsets, Doppelkanten, verzerrte Ergebnisse oder fehlgeschlagene Trainings,
- Datenverlust, Dateibeschädigung, unterbrochene Workflows oder Exportfehler,
- Ausfälle, Leistungsprobleme, Überhitzung, Batterieverbrauch oder Gerätedrosselung,
- Schäden aus der nachgelagerten Nutzung erzeugter Daten,
- indirekte Schäden, Folgeschäden oder entgangenen Gewinn.
Soweit Haftung nicht ausgeschlossen werden kann, ist sie auf das nach geltendem Recht zulässige Maß beschränkt.
11) Kein sicherheitskritischer Einsatz
Die App darf nicht für sicherheitskritische, gesundheitsbezogene oder rechtlich entscheidende Zwecke verwendet werden, beispielsweise für:
- Bauwerksanalysen oder Bauabnahmen,
- medizinische Diagnosen oder Therapieentscheidungen,
- sicherheitsrelevante Navigation oder Vermessung,
- oder behördliche/rechtliche Bewertungen als alleinige Entscheidungsgrundlage.
12) Updates / Änderungen
Deluva kann Funktionen der App jederzeit aktualisieren, ändern, aussetzen oder entfernen.
Es besteht kein Anspruch auf bestimmte Funktionen, Schnittstellen, Exportformate, Kompatibilität oder dauerhafte Verfügbarkeit.
13) Support
Support kann nach Ermessen von Deluva und im angemessenen Umfang angeboten werden, sofern nicht gesondert etwas anderes vereinbart wurde.
14) Beendigung / Nutzungsbeschränkung
Du darfst die App nur nutzen, solange du diese Nutzungsbedingungen und etwaige geltende Abonnement-Anforderungen einhältst.
Deluva kann den Zugang einschränken oder beenden, soweit dies gesetzlich zulässig ist, etwa bei Missbrauch, Betrug, technischem Risiko oder Verstoß gegen diese Bedingungen.
15) Schlussbestimmungen
Es gilt deutsches Recht, soweit gesetzlich zulässig. Gerichtsstand ist Berlin, soweit rechtlich zulässig.
Sollte eine Bestimmung dieser Nutzungsbedingungen unwirksam sein, bleiben die übrigen Bestimmungen unberührt.

2) Alcance
Estos Términos de Uso se aplican al uso de la app Lumina 3D y sus funciones para capturar, procesar, visualizar, organizar y exportar datos de imagen y escaneo, incluidas nubes de puntos LiDAR, poses de cámara, metadatos y conjuntos de datos compatibles con COLMAP.
Al utilizar la app, aceptas estos Términos de Uso. Si no estás de acuerdo, no debes usar la app.
3) Finalidad de la app
Lumina 3D es una app profesional para la captura y preparación de conjuntos de datos para escaneo 3D, fotogrametría, Gaussian Splatting y flujos de reconstrucción relacionados.
La app está diseñada para ayudar a los usuarios a capturar y preparar conjuntos de datos para su posterior procesamiento en Lumina 3D o en herramientas de terceros. Lumina 3D no es una herramienta garantizada de medición, inspección, topografía o certificación.
4) Cuentas, Iniciar sesión con Apple y suscripciones
Algunas funciones de la app pueden requerir una cuenta creada mediante Sign in with Apple y una suscripción activa adquirida a través de Apple.
Eres responsable de mantener el acceso a tu cuenta de Apple y de cumplir los términos de Apple para Sign in with Apple, suscripciones, facturación, renovaciones, cancelaciones, pruebas y canje de códigos promocionales.
El acceso a funciones de pago puede cambiar si:
- una suscripción expira,
- una prueba termina,
- un pago falla,
- una suscripción se cancela,
- o Apple informa que el acceso ya no está activo.
5) Limitaciones del sistema / calidad de resultados
La calidad de los resultados generados depende de muchos factores, incluidos:
- dispositivo y sensores (cámara/LiDAR, calibración, temperatura, CPU/GPU),
- condiciones de captura (movimiento, desenfoque por movimiento, exposición, ISO, rolling shutter),
- condiciones de iluminación, reflejos, vidrio, espejos, pantallas y escenas oscuras,
- estructura de la escena (poca paralaje, poca textura, patrones repetitivos),
- y procesamiento posterior en Lumina 3D o software de terceros.
No hay garantía de que cualquier escaneo, exportación o reconstrucción sea correcto, preciso, completo, ininterrumpido o apto para un propósito particular.
6) Responsabilidad del usuario
Eres el único responsable de:
- el uso legal de la app,
- obtener todos los derechos, permisos y consentimientos necesarios,
- cumplir con las leyes de privacidad, derechos de autor, propiedad y otras leyes aplicables,
- el almacenamiento, transmisión y uso seguro de tus datos,
- y verificar si los resultados generados son adecuados para tu flujo de trabajo previsto.
No debes usar la app de una manera que infrinja derechos de terceros o viole la ley aplicable.
7) Tratamiento de datos / privacidad (estado actual)
Lumina 3D procesa principalmente datos de escaneo e imagen de forma local en el dispositivo.
La información relacionada con la cuenta y la suscripción puede procesarse según sea necesario para Sign in with Apple, comprobaciones de entitlement, gestión de suscripciones y control de acceso de la app.
Actualmente Deluva no utiliza sistemas de análisis o rastreadores publicitarios dentro de la app.
Nota: los sistemas operativos y los servicios de Apple pueden procesar información de diagnóstico, facturación o suscripción a nivel del sistema. Deluva no tiene acceso al contenido de tus escaneos a menos que una función suba datos de forma explícita a un servicio controlado por Deluva.
8) Software de terceros y compatibilidad de exportación
Lumina 3D puede crear datos en estructuras de exportación destinadas a flujos de trabajo y software de terceros como COLMAP, Postshot, RealityScan u otras herramientas similares.
Las herramientas de terceros no forman parte de esta app y siguen sujetas a sus propias licencias, términos y limitaciones técnicas.
Deluva no garantiza la compatibilidad permanente con software de terceros, flujos de trabajo, formatos de archivo o futuras versiones de software.
9) Exclusión de garantía / “As Is”
La app se proporciona “tal cual” y “según disponibilidad”. El uso es bajo tu propio riesgo.
Deluva no garantiza:
- funcionamiento ininterrumpido o libre de errores,
- disponibilidad permanente de funciones,
- compatibilidad con todos los dispositivos, sistemas operativos o herramientas de terceros,
- ni un resultado específico de reconstrucción, exportación o entrenamiento.
10) Limitación de responsabilidad
En la medida permitida por la ley, Deluva no será responsable de:
- datos de escaneo/exportación inexactos, incorrectos, incompletos o inutilizables,
- errores de reconstrucción, desplazamientos, contornos dobles, resultados distorsionados o entrenamientos fallidos,
- pérdida de datos, corrupción de archivos, flujos de trabajo interrumpidos o fallos de exportación,
- interrupciones, problemas de rendimiento, sobrecalentamiento, consumo de batería o limitación del dispositivo,
- daños derivados del uso posterior de los datos generados,
- daños indirectos, daños consecuentes o lucro cesante.
Cuando la responsabilidad no pueda excluirse, se limitará al máximo permitido por la ley aplicable.
11) No usar en contextos críticos de seguridad
La app no debe utilizarse para fines críticos de seguridad, relacionados con la salud o legalmente decisivos, por ejemplo:
- análisis estructural o aceptación de edificios,
- diagnóstico médico o decisiones terapéuticas,
- navegación o topografía de seguridad,
- o evaluación oficial/legal como única base para una decisión.
12) Actualizaciones / cambios
Deluva puede actualizar, modificar, suspender o eliminar funciones de la app en cualquier momento.
No existe derecho a funciones específicas, interfaces, formatos de exportación, compatibilidad o disponibilidad permanente.
13) Soporte
El soporte puede ofrecerse a discreción de Deluva y dentro de un esfuerzo razonable, salvo acuerdo separado en contrario.
14) Terminación / restricción de uso
Puedes usar la app solo mientras cumplas estos Términos de Uso y cualquier requisito de suscripción aplicable.
Deluva puede restringir o terminar el acceso cuando la ley lo permita, por ejemplo en casos de uso indebido, abuso, fraude, riesgo técnico o violación de estos términos.
15) Disposiciones finales
Se aplica la ley alemana, en la medida permitida por la ley. El fuero competente es Berlín, siempre que sea legalmente permisible.
Si alguna disposición de estos Términos de Uso es inválida, las restantes seguirán siendo efectivas.

2) Ambito
I presenti Termini di utilizzo si applicano all’uso dell’app Lumina 3D e delle sue funzioni per acquisire, elaborare, visualizzare, organizzare ed esportare dati di immagini e scansioni, comprese nuvole di punti LiDAR, pose della fotocamera, metadati e dataset compatibili con COLMAP.
Utilizzando l’app, accetti i presenti Termini di utilizzo. Se non li accetti, non devi utilizzare l’app.
3) Scopo dell’app
Lumina 3D è un’app professionale per l’acquisizione e la preparazione di dataset per scansione 3D, fotogrammetria, Gaussian Splatting e relativi flussi di lavoro di ricostruzione.
L’app è progettata per aiutare gli utenti a catturare e preparare dataset per ulteriori elaborazioni in Lumina 3D o in strumenti di terze parti. Lumina 3D non è uno strumento garantito di misurazione, ispezione, rilievo o certificazione.
4) Account, Accedi con Apple e abbonamenti
Alcune funzioni dell’app possono richiedere un account creato tramite Sign in with Apple e un abbonamento attivo acquistato tramite Apple.
Sei responsabile del mantenimento dell’accesso al tuo account Apple e del rispetto dei termini Apple relativi a Sign in with Apple, abbonamenti, fatturazione, rinnovi, cancellazioni, prove e riscatto di codici promozionali.
L’accesso alle funzioni a pagamento può cambiare se:
- un abbonamento scade,
- una prova termina,
- un pagamento fallisce,
- un abbonamento viene cancellato,
- oppure Apple segnala che l’accesso non è più attivo.
5) Limitazioni del sistema / qualità dei risultati
La qualità dei risultati generati dipende da molti fattori, tra cui:
- dispositivo e sensori (fotocamera/LiDAR, calibrazione, temperatura, CPU/GPU),
- condizioni di acquisizione (movimento, motion blur, esposizione, ISO, rolling shutter),
- condizioni di illuminazione, riflessi, vetro, specchi, schermi e scene scure,
- struttura della scena (parallasse insufficiente, trama insufficiente, pattern ripetitivi),
- ed elaborazione successiva in Lumina 3D o software di terze parti.
Non vi è alcuna garanzia che una scansione, esportazione o ricostruzione sia corretta, accurata, completa, ininterrotta o adatta a uno scopo particolare.
6) Responsabilità dell’utente
Sei l’unico responsabile di:
- uso lecito dell’app,
- ottenimento di tutti i diritti, permessi e consensi necessari,
- conformità alle leggi applicabili in materia di privacy, copyright, proprietà e altre normative,
- conservazione, trasmissione e utilizzo sicuri dei tuoi dati,
- e verifica che gli output generati siano adatti al tuo flusso di lavoro previsto.
Non devi usare l’app in modo da violare diritti di terzi o la legge applicabile.
7) Trattamento dei dati / privacy (stato attuale)
Lumina 3D elabora principalmente i dati di scansione e immagine localmente sul dispositivo.
Le informazioni relative all’account e all’abbonamento possono essere trattate come necessario per Sign in with Apple, controlli entitlement, gestione degli abbonamenti e controllo dell’accesso all’app.
Attualmente Deluva non utilizza sistemi di analisi o tracker pubblicitari all’interno dell’app.
Nota: i sistemi operativi e i servizi Apple possono trattare informazioni diagnostiche, di fatturazione o di abbonamento a livello di sistema. Deluva non ha accesso al contenuto delle tue scansioni, a meno che una funzione non carichi esplicitamente dati su un servizio controllato da Deluva.
8) Software di terze parti e compatibilità di esportazione
Lumina 3D può creare dati in strutture di esportazione destinate a flussi di lavoro e software di terze parti come COLMAP, Postshot, RealityScan o strumenti simili.
Gli strumenti di terze parti non fanno parte di questa app e restano soggetti alle rispettive licenze, termini e limitazioni tecniche.
Deluva non garantisce compatibilità permanente con software di terze parti, flussi di lavoro, formati di file o future versioni software.
9) Esclusione di garanzia / “As Is”
L’app è fornita “così com’è” e “come disponibile”. L’uso è a tuo rischio.
Deluva non garantisce:
- funzionamento ininterrotto o privo di errori,
- disponibilità permanente delle funzioni,
- compatibilità con tutti i dispositivi, sistemi operativi o strumenti di terze parti,
- o uno specifico risultato di ricostruzione, esportazione o training.
10) Limitazione di responsabilità
Nella misura consentita dalla legge, Deluva non è responsabile per:
- dati di scansione/esportazione inaccurati, errati, incompleti o inutilizzabili,
- errori di ricostruzione, offset, doppi contorni, risultati distorti o training falliti,
- perdita di dati, corruzione di file, flussi di lavoro interrotti o errori di esportazione,
- interruzioni, problemi di prestazioni, surriscaldamento, consumo della batteria o limitazioni del dispositivo,
- danni derivanti dall’uso successivo dei dati generati,
- danni indiretti, consequenziali o perdita di profitti.
Laddove la responsabilità non possa essere esclusa, essa è limitata alla massima misura consentita dalla legge applicabile.
11) Nessun uso safety-critical
L’app non deve essere utilizzata per scopi safety-critical, relativi alla salute o giuridicamente decisivi, tra cui ad esempio:
- analisi strutturali o collaudi edilizi,
- diagnosi mediche o decisioni terapeutiche,
- navigazione o rilievo safety-relevant,

12) Aggiornamenti / modifiche
Deluva può aggiornare, modificare, sospendere o rimuovere funzioni dell’app in qualsiasi momento.
Non esiste alcun diritto a funzioni specifiche, interfacce, formati di esportazione, compatibilità o disponibilità permanente.
13) Supporto
Il supporto può essere offerto a discrezione di Deluva e nei limiti di uno sforzo ragionevole, salvo diverso accordo separato.
14) Risoluzione / restrizione d’uso
Puoi utilizzare l’app solo finché rispetti i presenti Termini di utilizzo e qualsiasi requisito di abbonamento applicabile.
Deluva può limitare o terminare l’accesso laddove consentito dalla legge, ad esempio in caso di uso improprio, abuso, frode, rischio tecnico o violazione dei presenti termini.
15) Disposizioni finali
Si applica il diritto tedesco, nella misura consentita dalla legge. Il foro competente è Berlino, ove legalmente consentito.
Se una disposizione dei presenti Termini di utilizzo è invalida, le restanti disposizioni restano invariate.

使用本应用即表示你同意本使用条款。如果你不同意，则不得使用本应用。
3) 应用目的
Lumina 3D 是一款专业应用，用于 3D 扫描、摄影测量、Gaussian Splatting 及相关重建工作流程中的数据集采集与准备。
本应用旨在帮助用户采集和准备数据集，以便在 Lumina 3D 或第三方工具中进一步处理。Lumina 3D 并非保证性的测量、检查、测绘或认证工具。
4) 账户、使用 Apple 登录与订阅
本应用的某些功能可能需要通过 Sign in with Apple 创建的账户以及通过 Apple 购买的有效订阅。
你有责任保持对自己 Apple 账户的访问权限，并遵守 Apple 关于 Sign in with Apple、订阅、计费、续订、取消、试用和优惠码兑换的条款。
以下情况可能会影响付费功能的访问：
- 订阅到期，
- 试用结束，
- 支付失败，
- 订阅被取消，
- 或 Apple 报告访问权限已不再有效。
5) 系统限制 / 结果质量
生成结果的质量取决于许多因素，包括：
- 设备和传感器（相机/LiDAR、校准、温度、CPU/GPU），
- 采集条件（运动、运动模糊、曝光、ISO、滚动快门），
- 光照条件、反射、玻璃、镜子、屏幕和暗场景，
- 场景结构（视差不足、纹理不足、重复图案），
- 以及在 Lumina 3D 或第三方软件中的后续处理。
我们不保证任何扫描、导出或重建结果是正确、精确、完整、不中断或适合某一特定用途的。
6) 用户责任
你需自行负责：
- 合法使用本应用，
- 获取所有必要的权利、许可和同意，
- 遵守适用的隐私、版权、财产权及其他法律规定，
- 安全存储、传输和使用你的数据，
- 以及确认生成的输出是否适合你的预期工作流程。
你不得以侵犯第三方权利或违反适用法律的方式使用本应用。
7) 数据处理 / 隐私（当前状态）
Lumina 3D 主要在设备本地处理扫描和图像数据。
账户和订阅相关信息可能会在 Sign in with Apple、权益检查、订阅处理和应用访问控制所需的范围内被处理。
Deluva 当前不在应用内使用分析系统或广告追踪器。
注意：操作系统和 Apple 服务可能会在系统层面处理诊断、计费或订阅相关信息。除非某项功能明确将数据上传到 Deluva 控制的服务，否则 Deluva 无法访问你的扫描内容。
8) 第三方软件与导出兼容性
Lumina 3D 可以创建供第三方工作流程和软件使用的数据导出结构，例如 COLMAP、Postshot、RealityScan 或类似工具。
第三方工具不属于本应用，其使用仍受各自提供方的许可证、条款和技术限制约束。
Deluva 不保证与任何第三方软件、工作流程、文件格式或未来软件版本保持永久兼容。
9) 免责声明 / “As Is”
本应用按“现状”和“可用状态”提供。使用风险由你自行承担。
Deluva 不保证：
- 应用运行持续不中断或无错误，
- 功能永久可用，
- 与所有设备、操作系统或第三方工具兼容，
- 或任何特定的重建、导出或训练结果。
10) 责任限制
在法律允许的范围内，Deluva 对以下情况不承担责任：
- 不准确、错误、不完整或不可用的扫描/导出数据，
- 重建错误、偏移、双重轮廓、失真结果或训练失败，
- 数据丢失、文件损坏、工作流程中断或导出失败，
- 中断、性能问题、过热、电池消耗或设备限速，
- 因后续使用生成数据而造成的损害，
- 间接损害、后果性损害或利润损失。
在不能排除责任的情况下，责任将限于适用法律允许的最大范围。
11) 不得用于安全关键用途
本应用不得用于安全关键、健康相关或具有法律决定性的用途，例如：
- 结构分析或建筑验收，
- 医疗诊断或治疗决策，
- 安全相关的导航或测绘，
- 或作为官方/法律评估的唯一依据。
12) 更新 / 变更
Deluva 可随时更新、修改、暂停或移除应用功能。
用户无权要求特定功能、接口、导出格式、兼容性或永久可用性。
13) 支持
除非另有单独约定，Deluva 可在合理范围内并根据其自行决定提供支持。
14) 终止 / 使用限制
只有在你遵守本使用条款及适用的订阅要求的情况下，才可以使用本应用。
在法律允许的情况下，例如发生滥用、欺诈、技术风险或违反本条款时，Deluva 可限制或终止访问。
15) 最终条款
在法律允许的范围内，适用德国法律。司法管辖地为柏林（在法律允许的情况下）。
如果本使用条款中的任何条款无效，其余条款仍然有效。
